North Carolina town approves 1-year data center moratorium to avoid getting 'caught unprepared'

The town is trying to get ahead of a fast-moving industry.

A fast-growing North Carolina town is hitting pause on data center construction before proposals for such facilities even arrive. 

As WBTV reported, leaders in Waxhaw voted to block new digital infrastructure applications for a year, saying they want time to strengthen local rules before any major proposal lands.

The moratorium gives Waxhaw a year to examine its land development rules after commissioners voted unanimously on August 11 to pause new data center proposals. No such project has been proposed in the town, the station noted.

"The main reason for doing it is because we want to make sure we don't get caught unprepared," Mayor Robert Murray III explained in the meeting, per WBTV.

Town officials added in a statement obtained by the station that the moratorium stops the "acceptance, processing and approval of development applications" related to digital-data facilities within Waxhaw's zoning jurisdiction.

Under the town's description, the freeze reaches not only data centers but also crypto-mining operations, data storage and processing uses, and telecommunications equipment associated with digital-data activity.

The goal is to avoid being rushed into decisions involving land use, infrastructure, and community impacts.

Data centers have become a flashpoint in many communities because they can require large amounts of electricity, extensive physical infrastructure, and, in some cases, significant water use for cooling. Even when they bring investment, they can also raise concerns about noise, land consumption, and pressure on local utilities.

Rather than waiting for a developer to submit plans, the town is trying to get ahead of a fast-moving industry that has spread across the country alongside rising demand for cloud computing, artificial intelligence, and digital storage.

Zoning decisions often shape traffic patterns, nearby development, utility costs, and the character of neighborhoods for years. A moratorium gives local governments a chance to study those tradeoffs before approving projects that may be difficult to reverse.

Waxhaw officials indicated that the current code may contain gaps, raising the possibility that a project could be filed before the town has updated its rules, as WBTV noted.

During the 12-month pause, the town plans to review its land development code and consider possible amendments.

Town officials also say the temporary freeze is meant to prevent an unexpected proposal from advancing through loopholes in the existing code.
